SPEAKER: Samuel Brotman, Owner and Managing Attorney of Brotman Law

SESSION TITLE:

The Employee Retention Tax Credit: How CPAs can protect their clients and themselves

SESSION DESCRIPTION:

The Employee Retention Tax Credit has presented an unprecedented challenge to the IRS, which was woefully unprepared for the problems that the credit has brought them. As a result, large scale IRS enforcement is coming not only against the taxpayers, but against their “professional facilitators” and others who promoted the credit illegitimately. Based on past actions, we have a few guesses at the actions that the IRS and DOJ may take to enforce compliance. Given the size and scale of the issues surrounding the credit, this presentation will discuss what the credit really is and what CPAs can do to help protect themselves professionally and their clients. We will also provide some best practices based on our early experiences with Employee Retention Tax Credit audits and share some war stories to help the audience know what to expect.

  • What is the Employee Retention Tax Credit and who qualifies?
  • Why has this become such a problem? What are the potential consequences?
  • What can CPAs do to protect themselves if they handled the credit filings and what can they do if asked to prepare the income tax returns? What are the ethical issues?

What can CPAs do to protect their clients?
